The terms for using BOMKGPL.
These terms govern the use of BOMKGPL, the gym management software. Using the service means a gym and its staff agree to them.
The agreement
When a gym or chain creates a BOMKGPL account, an agreement is formed between that organization and BOMKGPL. Staff who use the account do so under their organization's agreement and are responsible for following these terms.
Using the service properly
- Enter accurate member and payment information, and keep it current.
- Only record member data you are entitled to hold and process.
- Keep login credentials secure and limited to authorized staff.
- Don't attempt to disrupt, reverse-engineer, or resell the service.
Member data responsibility
The gym is the custodian of its members' data and is responsible for having a lawful basis to collect and use it. BOMKGPL processes that data to provide the service, as described in our Privacy Policy. A gym is responsible for how it acts on churn-risk scores and other insights the service produces.
Plans, billing, and renewals
Access is provided on the plan a gym selects, billed on the agreed cycle. Plans and limits, such as member and location counts, are set out at signup. As a gym approaches a limit, we will work with it to move to a suitable plan without interrupting service. Chain rollouts are governed by a separate onboarding agreement.
Availability
We work to keep BOMKGPL running reliably, but the service is provided on an as-available basis. Planned maintenance will be communicated where practical. We are not liable for losses arising from circumstances beyond our reasonable control.
Payment processing
Payments taken through BOMKGPL are handled by third-party payment providers. Their handling of payment credentials is subject to their own terms, and a gym's use of those features is subject to them as well.
Ending the agreement
A gym may close its account in line with the agreed terms. On closure, member data is handled as described in the Privacy Policy, including removal on a defined schedule. We may suspend access where these terms are seriously or repeatedly breached.
